2020 ELECTION ballots were being shredded just days after the November presidential election in Cobb County, Georgia on November 20, 2020, by a mobile shredding and recycling company.
Under 52 U.S.C. § 20701, federal law requires for all ballots and other election records from any election involving federal offices must be retained and preserved for a period of 22 months from the date of the election. This applies to all states and territories for federal contests.
For purely state or local elections without federal races on the ballot, retention periods can vary by state law—often 6 to 24 months or longer depending on the jurisdiction—but the federal requirement sets the minimum standard when applicable.
Destruction is only permitted after this period, and only if no ongoing investigations, audits, or legal challenges require further preservation.
