To be fair. JAG has judges and they also have Lawyers who either prosecute or defend. Judges never prosecute they only judge. They have every right under the constitution to hear a case of other than American citizens which is exactly what they will be doing. The area only becomes grey when the charged is an American Citizen non combatant in a tribunal. Then it can only been done if there is no other civil court available in the region or if the courts themselves have ceased to function.
