While I understand the point, this is not true.
Anyone - be they a citizen, visitor (legal or illegal, or immigrant (legal or illegal) IS SUBJECT TO THE LAWS OF THE USA - which include the U.S. Constitution.
The Constitution does NOT include any protections for anyone who is in the USA ILLEGALLY.
The Constitution DOES protect US citizens from BANISHMENT (ie. deportation).
The Constitution applies to anyone who agrees to abide by it. It is the basis for all other laws in the USA.
