I think more accurately the court has *acknowledged* the existing authority of the executive branch to do so
I don't think the Supreme court has the authority to "grant" anything

IMO this is a step in the reeducation of what the Executive Branch has authority to do in a Constitutional Republic .
There has been much talk of deferring to the (Compromised) Supreme Court...I believe this is being addressed..so not to leave anyone (Seeking) behind.
