My research which I have done numerous times over the years tell me that only if a country is under Martial Law can a Military Court prosecute and try a civilian.
A civilian is classed as anyone who is not sworn in under oath to one of the services provided by the Military.
I am not aware that the USA has been declared as being under Martial Law.
