Wrong. The U.S. SupremeCourt also hears cases that will set a legal precedent. This creates case law. The highest courts in each state work this way as well.

A law can't "confirm" that medical damage is "irreparable," only that compelling evidence INDICATES such MAY be the case, and therefore, based on that possibility or likelihood, sets a legal precedent for action.
