Federal Judge Rules in Favor of DOGE, Allowing Access to Key Federal Agency Data
In a significant legal victory for the Department of Government Efficiency (DOGE), a federal judge in Washington ruled Friday that the agency, led by Elon Musk, can access sensitive records from the Departments of Labor, Health and Human Services, and the Consumer Financial Protection Bureau. The decision, made by U.S. District Judge John Bates, declined a request by unions and nonprofits to temporarily block DOGE’s access to the data.
Judge Bates, appointed by President George W. Bush, concluded that DOGE is likely an agency under federal law, allowing it to detail its personnel to other agencies under the Economy Act. In his opinion, however, Bates noted the complexity of DOGE’s classification, referring to it as a “Goldilocks entity: not an agency when it is burdensome but an agency when it is convenient.”
