Powell also forgot to mention that Admiralty Law of the Crown that protected "THE FED" no longer applies, because we live in a Constitutional Republic. Therefore the "law" that Powell is referring to has no further jurisdiction or authority in America.
Under a Military Jurisdiction, in fact, THE FED would be considered a "belligerent", and at this late time that would assuredly be an unlawful, undeclared, or "unprivileged belligerent".

Of course, there were no phones, internet or TVs back then. Radio neither.
