The entire mandate was based on lies.

1. The two shots were not the same formulation. One didn't exist to be compared with. It's imaginary. One was "dilute," the other "must dilute".
2. They are not legally interchangeable.
3. The BLA approval was rescinded the same day it was approved.
4. This letter was written because there was never stock of fully FDA approved COMIRNATY in accordance with labeling and guidance. I can testify to that.
5. The JAG here knew he had to be careful of language used. This is why he chose the word "can" use as opposed to "must." This gives him and the people bit of cover, but not enough if it goes to trial.
